By accessing or using the My Mind website, mobile application, and related services (collectively, the "Service"), you agree to comply with and be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our Service. My Mind reserves the right to update or modify these terms at any time without prior notice. Your continued use of the Service after any changes constitutes acceptance of the new terms.

You must be at least 18 years old to use our Service. By using My Mind, you represent and warrant that you are at least 18 years of age. If you are under 18, a parent or legal guardian may use the Service on your behalf with appropriate consent. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.
My Mind provides mental health support, psychoeducation, and connection to licensed professionals, but it is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on our platform.

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are solely responsible for maintaining the confidentiality of your password and account. You agree to notify us immediately of any unauthorized use of your account. My Mind will not be liable for any loss or damage arising from your failure to comply with these obligations.
Certain features of My Mind require payment. All fees are clearly displayed on our Pricing page. By subscribing to a paid plan, you authorize us to charge your provided payment method on a recurring basis (monthly or yearly) until you cancel. Subscriptions automatically renew unless canceled at least 24 hours before the renewal date. Refunds are handled on a case-by-case basis; generally, we do not provide refunds for partially used subscription periods. You can cancel anytime from your account settings.
My Mind provides mental health services via telehealth (video, audio, and messaging). You understand and agree that telehealth has potential benefits and risks, including but not limited to technical failures, interruption of sessions, and the possibility that information transmitted may not be sufficient for certain diagnoses. By using our platform, you consent to receive services via telehealth and acknowledge that you have been informed of alternative in-person care options.
Mental health providers on our platform are independent contractors, not employees of My Mind. My Mind facilitates connections but does not practice medicine or therapy directly. Each provider is responsible for their own clinical decisions, licensure, and adherence to ethical standards. You will enter into a direct therapeutic relationship with the provider you select. My Mind does not interfere with clinical judgment.
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the platform. Prohibited activities include:
All content on My Mind — including text, graphics, logos, software, and educational materials — is the property of My Mind or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission. You retain ownership of any content you submit (e.g., mood logs, messages), but grant us a limited license to use that content to provide and improve our services.
Either party may terminate your account at any time for any reason. You may cancel your subscription via account settings. We may suspend or terminate your access if we believe you have violated these terms. Upon termination, you will lose access to your account data unless required by law to retain certain health records. For continuity of care, we will provide you with a copy of your records upon request.
To the maximum extent permitted by law, My Mind and its affiliates, officers, employees, and providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the past 12 months. Some jurisdictions do not allow the exclusion of certain warranties, so this limitation may not apply to you.
⚖️ You agree to indemnify and hold My Mind harmless from any claims, damages, or expenses arising from your violation of these terms or misuse of the Service.
These terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising from these terms or your use of the Service shall be resolved through binding arbitration in San Francisco County, California, rather than in court. You waive the right to participate in class actions. Notwithstanding the foregoing, either party may seek injunctive relief in court to protect intellectual property or confidential information.
